Welcome to Malevolent Gaming’s City of Heroes Server (the “Service”).
By creating an account, logging in, downloading the launcher, or accessing any game, website, or Discord channel related to the Service, you agree to the following Terms of Service (“Terms”). If you do not agree, you may not use the Service.
1. Non-Affiliation
This City of Heroes private server is a fan-operated, non-commercial project.
Malevolent Gaming, Malevolent Multiverse, and associated services are NOT affiliated with or endorsed by:

Paragon Studios
Homecoming Team
Any current or former owners of the “City of Heroes” intellectual property
All trademarks and copyrights remain property of their respective owners.
2. Eligibility
To access the Service, you must:
Be at least 13 years old, or meet your local legal minimum age
Not be prohibited by your region’s laws from participating
Agree to follow these Terms and all posted gameplay rules
Violation of eligibility may result in immediate account removal.
3. Accounts
By registering an account:
You are responsible for keeping your username and password secure
Account sharing is not permitted
Staff may lock, suspend, or delete accounts found to be compromised or misused
You may not buy, sell, trade, or transfer accounts
You are fully responsible for all activities performed under your account.
4. Code of Conduct
You agree not to engage in:
Prohibited Behavior
Harassment, hate speech, threats, or discriminatory language
Griefing, spam, or targeted disruption of gameplay
Using exploits, cheats, bots, macros, or unauthorized third-party tools
Abusing game systems, mission farms, or unintended mechanics
Impersonating staff members
Advertising real-money transactions (RMT)
Evading or assisting others with ban evasion
Sharing personal information (doxxing)
Violations may result in warnings, temporary bans, or permanent account removal.
5. Gameplay Rules
To support fair and stable gameplay, you agree to:
Report exploits, bugs, or dupes immediately
Avoid AFK farming unless explicitly permitted
Not modify or manipulate game files beyond what is strictly required for the client
Respect roleplay spaces and established community guidelines
Follow staff direction during events, investigations, or testing
The staff reserves full authority to adjust balance, wipe exploits, or enforce gameplay rules as needed.
6. Donations
Donations support hosting, development, and infrastructure
Donations are strictly voluntary
Donations do not grant special privileges, power, or immunities
Donors are treated exactly the same as other players regarding rules and enforcement
All donations are non-refundable
7. Intellectual Property
You acknowledge that:
All City of Heroes, Paragon Studios, and related content belongs to its respective rights holders
All custom content created by Malevolent Gaming staff is the property of Malevolent Gaming
Redistribution or modification of server files or source code is prohibited without explicit written permission
8. Website, Launcher & Tools
When using the website, launcher, or any support tools, you agree not to:
Attempt unauthorized access, reverse engineering, or penetration of systems
Upload malicious files, scripts, or automated requests
Abuse forms, endpoints, APIs, or authentication systems
Circumvent account protection measures or Discord verification
The website and launcher are provided as-is and may be offline without notice.
9. Privacy & Data
We collect only the minimum information necessary to operate the Service:

Attempting to evade a ban or helping others evade bans
Advertising real-money transactions (RMT) of items, accounts, or characters
Sharing personal information of others (doxxing)
Staff reserve full discretionary authority to enforce conduct rules.
5. Gameplay Rules
To maintain fairness and server stability, you agree to:
Report bugs, dupes, and exploits immediately
Not intentionally cause lag, crashes, or server instability
Avoid monopolizing content in a way that harms other players
Follow staff instructions during investigations or events
Not alter client or game files beyond required EQEmu configurations
Staff may modify characters, inventory, quests, or items if needed for stability or exploit prevention.
6. Multi-Boxing / Automation

Default wording:
Multi-boxing is allowed unless otherwise specified on the server rules page
Full automation, unattended gameplay, or botting software is strictly prohibited
Keyboard broadcasting to multiple clients simultaneously may be restricted
7. Donations
Donations are voluntary and support hosting and development costs
Donations do not grant special powers, advantages, or immunity from rules
Donation rewards (if any) are purely cosmetic or convenience-based
All donations are non-refundable
Donors are subject to the same enforcement as all other players
8. Intellectual Property
You acknowledge that:
All EverQuest-related content belongs to its IP owners
EQEmulator is an independent, fan-maintained open-source project
Our server uses EQEmu software under its open-source license
Custom content developed by Malevolent Gaming remains our property
Unauthorized redistribution of server code or assets is prohibited
9. Website, Launcher & Tools
When accessing the website or launcher, you agree:
Not to attempt unauthorized access, reverse engineering, or exploitation
Not to upload malware, scripts, or harmful files
Not to spam, overload, or disrupt the Service
To comply with Discord’s own Terms of Service when linked
Uptime and service availability are not guaranteed.
10. Data & Privacy

11. Staff Authority & Enforcement

Staff decisions are final
Staff may modify or remove accounts, characters, houses, guilds, or items for rule enforcement
Staff may issue bans, suspensions, warnings, or data adjustments at any time
Evidence gathering may involve reviewing logs, chat records, and game behavior
Players may submit appeals, but reversals are not guaranteed.
